GENERAL CONDITIONS OF SALE
Art. 1 – Acceptance of the general conditions of sale and conclusion of the contract
The contract concluded between Lesamaranti srl. (hereinafter referred to as “Lesamaranti”) and the Customer (i.e. the person, natural person, who makes the purchase on the Site, not referable to his own commercial, entrepreneurial or professional activity) shall be considered concluded with the acceptance, even partial, of the order by Lesamaranti. In case of non-acceptance of the order, Lesamaranti will in any case promptly notify the Customer.
By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares that he/she has read all the information provided to him/her during the purchase process and fully accepts these general conditions (hereinafter the “Conditions”).
These Conditions may be printed or saved in a durable medium, subject to the provisions of Art. 12 of Legislative Decree. 70/2003 and by Art. 51 of Legislative Decree. 206/2005, as amended by Legislative Decree 21/2014.
Art. 2 – Method of purchase
The products offered for sale by Lesamaranti are only those on Lesamaranti’s website at the time of placing the Order, as described in the relevant information sheets.
It is in any case understood that the images accompanying the descriptive sheet of a product are for information purposes only and may not be perfectly representative of its characteristics but differ e.g. in color and size (also due to the browser and monitor used to access the Site and view the images).
In order to place an Order, the Customer will have to fill in the relevant form on the Site in its entirety and submit it after carefully reviewing the Conditions, as well as the characteristics of the product and/or products he/she intends to purchase. The Customer shall also request from Lesamaranti, if it wishes, the issuance of a tax invoice relating to the purchase, pursuant to Art. 22 Presidential Decree no. 633/1972.
The correct receipt of the Order is confirmed by Lesamaranti by an e-mail response, sent to the e-mail address provided by the Customer. This confirmation message will summarize the conditions of purchase, as required by the applicable regulations, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and, if necessary, communicate without delay the necessary corrections of incorrect data
Art. 3 – Prices and Method of Payment
The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the customer through the site or these conditions.

Credit card:
In cases of purchase of goods with credit card payment method, the transaction may take place through the secure server Paypal or other secure server chosen by Lesamaranti. In no case and at no stage of the payment Lesamaranti will be able to know the information about the customer’s credit card, transmitted via secure connection directly to the site of the banking institution handling the transaction. No computer records of Lesamaranti will retain such data and therefore under no circumstances can Lesamaranti be held liable for any fraudulent and improper use of credit cards by third parties at the time of payment.
Bank transfer:
In case of purchase by bank transfer, the bank details for payment will be displayed. Payment by bank transfer involves an additional cost of Euro 8.00 charged to the customer. The shipment of the goods will take place only upon actual receipt of the payment in the bank.

Article 4 – Delivery of products and related expenses
The purchased products will be delivered to the address indicated by the Customer in the Order within 3-4 working days in Italy and within 4-6 working days in European and non-European countries from the acceptance of the Order by Lesamaranti, at the cost specifically indicated in the Site before sending the Order. Lesamaranti reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times may vary.
With regard to deliveries requested to countries outside the European Union, any import customs fees will be borne by the recipient. Therefore, the Customer is encouraged to contact the customs authorities in his or her country in advance to verify the costs and any import limits.
The delivery times indicated by Lesamaranti must be considered as purely indicative and a delay with respect to them, or any delivery made with successive fractionated shipments do not entitle the Customer to refuse the delivery itself and the request for compensation or indemnity.
Upon delivery of the products, the Customer is required to check:
That the number of packages being delivered corresponds to what is indicated in the transport document.
that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately detected, placing a specific indication on the delivery document of the product to be returned to the courier.
Any problems inherent in the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery in the manner provided herein.
Art. 5 – Right of withdrawal
Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the customer may withdraw from the conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products (30 days for the USA) .
In order to exercise the right of withdrawal referred to in Article 5.1 above, customer must send Lesamaranti a notice to that effect, within the terms indicated, to the following email address store@lesamaranti.com, or use the appropriate form on the Site.
In the event of withdrawal, the customer must resend the products to Lesamaranti at his or her own expense within 14 (fourteen) days of such withdrawal (30 days for the U.S.).
Registered users will be able to access the “RETURNS” section of their user dashboard and manage return requests.

The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:
the right of withdrawal may apply to the product purchased in its entirety; in fact it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, complements, etc …);
for the withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, seals, etc …);
the shipping costs (and any customs fees, if any) for the return of the goods will be the sole responsibility of the Customer;
the shipment, until the certificate of receipt in the warehouse indicated by Lesamaranti, is under the complete responsibility of the customer;
Lesamaranti will not be liable in any way for damage, theft, loss occurring during or otherwise in dependence of the return shipment.
Lesamaranti will refund to the customer the full amount already paid, within 14 (fourteen) days from the withdrawal, through the procedure of reversal of the amount charged, using the same means of payment used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not bear any costs as a consequence of this refund. Lesamaranti may suspend the refund until receipt of the returned product or until the customer demonstrates that he has properly returned the product, whichever is earlier.
In any case, the client will forfeit the right of withdrawal in cases where Lesamaranti determines that:
the returned product and / or its accessories, and / or its packaging are not intact;
the product is missing its external packaging and / or its original internal packaging;
the product is missing its integral elements and / or accessories (eg closures, laces, buckles, etc.).
In case of forfeiture of the right of withdrawal, Lesamaranti will return to sender the product purchased, charging the same shipping costs and, where already refunded, the price of the product.
Art. 6 – Guarantees
All products sold by Lesamaranti are covered by the warranty of 24 (twenty-four) months for conformity defects, pursuant to Title III of Legislative Decree. 206/2005. To take advantage of warranty service, the Customer must keep the invoice, i.e., the payment receipt, along with the shipping document.
The warranty for defects of conformity will apply provided that the respective product has been used correctly, in accordance with its intended use and with the provisions of the use and washing instructions in and/or with the product.
In the event that, for any reason, Lesamaranti is not able to return to the Customer a product under warranty (repaired or replaced), or where the repair or replacement were, even by reason of the value of the product, excessively onerous, Lesamaranti may proceed to the appropriate reduction of the price paid, or refund the full amount paid with termination of the contract.
In cases where the application of warranties provides for the return of the product, the same must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).
PLEASE NOTE: It is not possible to request an exchange or refund of a customized product (with explicit letters requested by the customer, etc.), unless the goods are defective or do not conform to the order placed (Article 5 paragraph 3 letter c of Legislative Decree No. 185 of 22/05/1999).

Article 8 – Privacy.
The personal data collected with the submission of the Order will be processed by Lesamaranti for the sole purpose of fulfilling the express requests of the Customer, in accordance with EU Regulation 2016/679 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Client.
Article 9 – Applicable Law
The contract of sale referred to in these Conditions and its execution and governed by Italian Law, with the disapplication of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer’s municipality of residence shall have jurisdiction to resolve the relevant disputes.
Art. 10 – Copyright
Trademarks, logos and other distinctive signs on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs including reproduction on other websites by unauthorized third parties is prohibited. The contents of the site are protected by copyright (text, images and graphics).
Art. 11 – Agreement
The contract supersedes all previous contracts, agreements, and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the site, and the conditions relating to the registration service. Any changes or amendments to the contract must be accepted in writing by both parties.
Art. 12 – Communications
All communications between the parties shall be in writing and sent to the other party’s address specified in the contract and order. Communications sent to the other party’s e-mail address listed on the site and in the order are also considered to have been sent in writing
Communications regarding the validity or existence of this agreement shall be exclusively hand-delivered or sent by registered letter with Return Receipt Notice.
Art. 13 – Language
The sales contract is written in two versions: Italian, English. In case of discrepancies in translation, the Italian language version will prevail.
